Campaign for Tobacco-Free Kids president Matthew Myers, a strong supporter of San Francisco’s flavoring ban, noted that tobacco industry legal challenges to the bans in those cities were unsuccessful.

He told MedPage Today that he believes any legal challenges to the San Francisco action, and a similar ban on flavored tobacco under consideration in nearby Oakland, will also fail. “There is little question that the industry will challenge this. But based on existing precedent and existing law, my feeling is that both of these are on solid legal ground.”

Banning flavors from tobacco products has long been a focus of Campaign for Tobacco-Free Kids and other anti-smoking groups. Myers said it is probably no coincidence that youth cigarette smoking rates have dropped dramatically — to record lows — in the time since the ban went into effect.
